These Terms and Conditions govern the provision of roofing services by A D Roofing to clients across New South Wales, the Australian Capital Territory and Queensland. By engaging A D Roofing to provide services, you agree to be bound by these terms.

A D Roofing is a licensed roofing contractor operating across New South Wales, the Australian Capital Territory and Queensland.
2. Definitions
In these Terms and Conditions:
- "A D Roofing", "we", "us" or "our" refers to A D Roofing.
- "Client", "you" or "your" refers to the person, company or entity engaging A D Roofing to provide services.
- "Quote" means the written, itemised quotation provided by A D Roofing to the Client for a specific scope of works.
- "Scope of Works" means the specific roofing services described in the Quote.
- "Services" means all roofing, cladding, guttering, asbestos removal and related services provided by A D Roofing.
- "Site" means the property at which the Services are to be carried out.
3. Quotes and Acceptance
3.1 All quotes are provided in writing and are valid for 30 days from the date of issue unless otherwise stated.
3.2 A quote constitutes an offer by A D Roofing to provide the Services described in the Scope of Works at the price stated. A contract is formed when the Client accepts the quote in writing, by email confirmation, or by authorising commencement of works.
3.3 Quotes are based on information available at the time of inspection. If unforeseen conditions are discovered during the works — including but not limited to structural defects, additional asbestos-containing materials, or concealed damage — A D Roofing will notify the Client promptly. Any variation to the scope or price will be agreed in writing before additional works proceed.
3.4 A D Roofing does not provide verbal estimates. All pricing is provided in writing.
4. Prices and Payment
4.1 All prices are quoted in Australian dollars and are exclusive of GST unless otherwise stated. GST will be added to the final invoice at the applicable rate.
4.2 Payment terms are as specified on the invoice issued by A D Roofing. Unless otherwise agreed in writing, invoices are due and payable within 14 days of the invoice date.
4.3 For large commercial and industrial projects, A D Roofing may require progress payments at agreed milestones. These will be specified in the Quote.
4.4 Payment may be made by electronic funds transfer (EFT) to the bank account specified on the invoice, or by another method agreed in writing.
4.5 If the Client fails to pay an invoice by the due date, A D Roofing reserves the right to:
- Charge interest on the outstanding amount at the rate of 2% per month compounding from the due date
- Suspend further works until the outstanding amount is paid in full
- Engage a debt collection service or take legal action to recover the outstanding amount
- Recover all reasonable costs of collection, including legal fees, from the Client
4.6 A D Roofing reserves the right to place a caveat, lien or other security interest over the property at which Services were provided if an invoice remains unpaid after 30 days of the due date.
5. Scope of Works and Variations
5.1 A D Roofing will carry out the Services as described in the agreed Scope of Works.
5.2 Any request by the Client to vary the Scope of Works — including adding, removing or modifying elements of the works — must be agreed in writing between both parties before any variation is carried out.
5.3 Variations may result in changes to the price and timeline. A D Roofing will provide a written variation quote for any additional works before proceeding.
5.4 Where unforeseen site conditions require a variation — for example, the discovery of additional asbestos-containing materials, structural defects or concealed damage not apparent at the time of inspection — A D Roofing will notify the Client in writing as soon as practicable and will not proceed with the variation until written approval is received.
6. Client Responsibilities
6.1 The Client must provide A D Roofing with safe, unobstructed access to the Site and all areas of the building necessary to carry out the Services.
6.2 The Client must inform A D Roofing of any known hazards at the Site, including but not limited to the presence of asbestos-containing materials, unstable structures, electrical infrastructure, or other risks that may affect the health and safety of A D Roofing's personnel.
6.3 The Client must ensure that all necessary approvals, consents, body corporate authorisations and owner permissions are obtained before works commence. A D Roofing is not responsible for delays arising from the Client's failure to obtain required approvals.
6.4 The Client must provide accurate information about the Site, the building and the nature of the works required. A D Roofing's quote is based on the information provided at the time of inspection and quotation.
6.5 Where the Client is a strata manager, property manager or agent acting on behalf of a building owner or owners corporation, the Client warrants that they have authority to engage A D Roofing on behalf of the owner and to approve the Scope of Works and any variations.
7. Workmanship Guarantee
7.1 A D Roofing provides a written workmanship guarantee on all Services. The terms and duration of the guarantee are specified in the written guarantee document provided at project completion.
7.2 The workmanship guarantee covers defects arising from A D Roofing's installation or repair works. It does not cover:
- Damage caused by events beyond A D Roofing's control, including severe weather events, storms, hail, floods, fire or acts of God
- Damage caused by the Client or third parties after completion of works
- Pre-existing defects or damage not identified in the Scope of Works
- Normal wear and tear
- Failure of materials due to causes beyond A D Roofing's control
7.3 The product warranties provided by BlueScope Steel and other materials manufacturers are separate from and in addition to A D Roofing's workmanship guarantee. A D Roofing does not warrant product warranties beyond what the manufacturer provides.
7.4 To make a claim under the workmanship guarantee, the Client must notify A D Roofing in writing at adroofing@ymail.com within the guarantee period, providing a description of the defect and supporting photographic evidence where possible.
8. Asbestos Works
8.1 Where the Scope of Works includes the removal or disturbance of asbestos-containing materials, A D Roofing will carry out all asbestos works in accordance with the applicable state and territory work health and safety legislation, regulations and codes of practice, including the Safe Work Australia Code of Practice for Asbestos Work.
8.2 The Client must provide A D Roofing with any existing asbestos register, asbestos management plan or other asbestos documentation for the Site prior to the commencement of works.
8.3 A D Roofing will lodge all required asbestos removal notifications with the relevant state authority — SafeWork NSW, WorkSafe ACT or SafeWork Queensland as applicable — at least 5 business days before asbestos works commence. The Client must provide all information necessary to complete the notification in a timely manner.
8.4 On completion of all asbestos removal works, an independent licensed asbestos assessor will carry out a clearance inspection and issue a clearance certificate. The clearance certificate will be provided to the Client as part of the project documentation package.
8.5 All asbestos waste will be transported and disposed of at a licensed asbestos waste disposal facility. A D Roofing will provide disposal documentation to the Client on project completion.
9. Safety and Site Management
9.1 A D Roofing will carry out all works in accordance with applicable work health and safety legislation in the relevant state or territory.
9.2 A D Roofing will prepare and implement site-specific Safe Work Method Statements and risk assessments for all high-risk activities before work commences.
9.3 The Client must not interfere with A D Roofing's safety controls, exclusion zones or safety equipment at any time during the works.
9.4 A D Roofing reserves the right to suspend works immediately if the safety of its personnel or others at the Site is at risk. Works will not resume until the safety issue is resolved.
10. Insurance
10.1 A D Roofing holds public liability insurance in amounts compliant with applicable licensing requirements. Certificates of currency are available on request.
10.2 The Client is responsible for ensuring that the property is adequately insured for the duration of the works.
10.3 A D Roofing is not responsible for loss or damage to the Client's property, contents, stock or equipment arising from circumstances beyond A D Roofing's reasonable control, including severe weather events occurring during the course of works.
11. Limitation of Liability
11.1 To the maximum extent permitted by law, A D Roofing's total liability to the Client for any claim arising out of or in connection with the Services — whether in contract, tort, statute or otherwise — is limited to the amount paid by the Client to A D Roofing for the Services giving rise to the claim.
11.2 A D Roofing is not liable for any indirect, consequential, special or incidental loss or damage, including but not limited to loss of profits, loss of revenue, loss of business, loss of data, or loss arising from business interruption.
11.3 Nothing in these Terms and Conditions excludes or limits any rights the Client may have under the Australian Consumer Law that cannot be excluded or limited by contract.
12. Australian Consumer Law
12.1 Our Services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us, and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
13. Dispute Resolution
13.1 If a dispute arises between A D Roofing and the Client in connection with these Terms and Conditions or the Services, the parties agree to attempt to resolve the dispute by good-faith negotiation before commencing any formal legal proceedings.
13.2 Either party may initiate the dispute resolution process by notifying the other party in writing of the nature of the dispute. The parties will then have 14 days to attempt to resolve the dispute by negotiation.
13.3 If the dispute cannot be resolved by negotiation within 14 days, either party may refer the dispute to mediation through a mutually agreed mediator or through the relevant state dispute resolution body.
13.4 Nothing in this clause prevents either party from seeking urgent injunctive or other interlocutory relief from a court.
14. Cancellation and Suspension
14.1 The Client may cancel a confirmed engagement before works commence by providing written notice to A D Roofing at adroofing@ymail.com. If the Client cancels after materials have been ordered or manufactured for the project, the Client may be liable for the cost of those materials.
14.2 A D Roofing reserves the right to suspend or terminate the Services where:
- The Client fails to make payment by the due date
- The Client fails to provide safe access to the Site
- The Client breaches any material term of these conditions
- Continuing the works would create an unacceptable health or safety risk
14.3 Where A D Roofing suspends or terminates the Services due to the Client's breach, the Client remains liable for all amounts owing for works carried out to the date of suspension or termination, plus any reasonable costs incurred by A D Roofing arising from the suspension or termination.
15. Intellectual Property
15.1 All designs, drawings, plans and documentation prepared by A D Roofing in connection with the Services remain the intellectual property of A D Roofing unless otherwise agreed in writing.
15.2 A D Roofing reserves the right to take photographs of completed works for portfolio, marketing and case study purposes. No personally identifiable information about the Client will be disclosed without the Client's consent.
16. Privacy
16.1 A D Roofing collects and handles personal information in accordance with its Privacy Policy, available at www.ad-roofing.com.au/privacy-policy and the Australian Privacy Act 1988 (Cth).
17. Governing Law
17.1 These Terms and Conditions are governed by the laws of New South Wales, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of New South Wales.
18. Severability
18.1 If any provision of these Terms and Conditions is found to be invalid, unenforceable or illegal, that provision will be severed from these Terms and Conditions and the remaining provisions will continue in full force and effect.
19. Entire Agreement
19.1 These Terms and Conditions, together with the written Quote and any agreed written variations, constitute the entire agreement between A D Roofing and the Client in relation to the Services. They supersede all prior negotiations, representations, warranties and understandings between the parties.
